These terms of use are entered into by and between You and DineWatch ("Company," "we," or "us"). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms of Service"), govern your access to and use of dinewatch.app, including any content, functionality, and services offered on or through dinewatch.app ("DineWatch"), whether as a guest or a registered user.
Please read the Terms of Service carefully before you start to use DineWatch. By using DineWatch, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, found at dinewatch.app/privacy, incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use DineWatch.
DineWatch is offered and available to users who are 18 years of age or older. By using DineWatch, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use DineWatch.
Some DineWatch features may be offered under paid subscription plans. If You purchase a paid plan, You agree to pay the price, billing interval, and any applicable taxes or fees displayed during checkout. Payments and subscription billing are handled through Dodo Payments. Dodo Payments acts as merchant of record for the transaction and will appear on your card statement, receipts, and invoices.
Unless otherwise stated at checkout, paid subscriptions renew automatically until cancelled. By starting a paid subscription, You authorize recurring charges using the payment method You provide. If a payment attempt fails, We or Dodo Payments may retry the charge, request an updated payment method, suspend paid access, or downgrade the account to the free plan until billing is resolved.
Dodo Payments also handles invoicing, tax calculation and remittance, and payment-related dispute workflows for Premium subscriptions. Premium purchases are also subject to the Dodo Payments Buyer Terms.
You may cancel a paid subscription at any time. When You cancel, access to the paid plan remains available through the end of the paid billing period unless otherwise required by law.
Our current launch policy is a 7-day refund window for first-time purchases. Renewal charges are generally not refunded once processed except where required by law or where We choose to make an exception. Refunds processed through Dodo Payments are also subject to the Dodo Payments Buyer Terms. See our Refund and Cancellation Policy for the current policy.
DineWatch is a monitoring and notification service only. We monitor publicly available Disney dining reservation availability and notify You when a matching slot appears. We do not book reservations on Your behalf, interact with Disney's systems in any transactional way, auto-book, process payments with Disney, or facilitate reservations in any form. When You receive an alert, You are responsible for visiting Disney's own platform and completing the booking independently.
We do not sell, own, or control Disney reservations, and We do not guarantee that any reservation will become available, that an alert will always be delivered, or that a reservation will still be available when You attempt to book it.
Free and Premium plans may differ in alert limits, supported parks, monitoring cadence, and available notification channels. We may improve or adjust plan features from time to time, provided that any active paid subscription will continue to receive the features that are materially described at checkout unless We notify You of a change.
If You create a reservation alert with DineWatch, You agree to receive operational notifications related to that alert. Email notifications are available on all plans. Additional channels such as Telegram, Discord, or future channels may only be available on eligible plans and may require separate setup.
Notification volume will vary based on how many times matching reservations are found. Delivery depends on third-party networks, platform availability, device settings, and the accuracy of the contact information You provide.
If You believe a Premium charge was made in error, contact support@dinewatch.app before initiating a chargeback when possible. Dodo Payments may administer payment disputes, refunds, and chargeback processes as part of its merchant-of-record role.
You will only receive promotional messages from DineWatch if You have opted in. You may opt out of promotional messages at any time via the unsubscribe link included in messages, logging in and opting out in your profile, or by contacting DineWatch directly. DineWatch user data and order data is never sold to any third parties for the purposes of promotions, sales, advertising, etc.
We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of DineWatch thereafter.
Your continued use of DineWatch following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
We reserve the right to withdraw or amend DineWatch, and any service or material we provide on DineWatch, in our sole discretion without notice. We will not be liable if for any reason all or any part of DineWatch is unavailable at any time or for any period. From time to time, we may restrict access to some parts of DineWatch, or the entirety of DineWatch, to users, including registered users.

To access DineWatch or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of DineWatch that all the information you provide on DineWatch is correct, current, and complete. You agree that all information you provide to register with DineWatch or otherwise, including, but not limited to, through the use of any interactive features on DineWatch, is governed by our Privacy Policy (dinewatch.app/privacy), and you consent to all actions we take with respect to your information consistent with our Privacy Policy.
If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to DineWatch or portions of it using your user name, password, or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.
We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service.
DineWatch and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms of Service permit you to use DineWatch for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on DineWatch, except as follows:

The Company name, the term DineWatch, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on DineWatch are the trademarks of their respective owners.
When you use the DineWatch services, DineWatch's role is to monitor publicly available dining reservation availability and notify You when a match is found. DineWatch does not provide, endorse, or guarantee any third-party product, service, or information. DineWatch is not affiliated with the third parties featured within, or utilized as part of, the services and is not responsible for their products and services.
We are not affiliated in any way with The Walt Disney Company or any of its affiliates or subsidiaries. DineWatch has no partnership, endorsement, or commercial relationship with The Walt Disney Company. We do not act on Disney's behalf, represent Disney in any capacity, or transact with Disney's systems. We monitor publicly available availability information only. Disney trademarks are property of The Walt Disney Company.

YOUR USE OF DINEWATCH, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH DINEWATCH IS AT YOUR OWN RISK. DINEWATCH, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH DINEWATCH ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, DINEWATCH, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of DineWatch.
All matters relating to DineWatch and these Terms of Service, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the United States without giving effect to any choice or conflict of law provision or rule.
